The H-1 time will be preserved, but your employer will have to apply as
you said. In the application for H1 there is a section to show your
time on H1 previously. You should keep all of your travel records going

(E-2) expires in 2010. With an approved I-140, will it be a problem

Hello
I have a H1 visa that will finish its 6 yr term in Sep 2010. I wish to
pursue a full time MBA next year and my visa will get changed to F1.
Once I am done with my MBA and apply for a new H1, will the H1 still
have a year of work left on it or will it reset to a new 6 yr term ?

I changed my employer in the US and got a new H1 B visa in 2007 and
was employed from Oct 2007. After staying in the US till Dec 20th,
2007, I was deputed to India by my employer for short term assignment
and this assignment kept on extending and finally, I was terminated by

They don't ask that on the I-94W or for ESTA - just the stuff about "are
you applying to enter the USA in order to commit a terrorist outrage -
come on, be honest now". Not that it makes much difference these days as

Of course, it is not impossible to get a non-immigrant visa or be admitted on
visa waiver once an I-140 has been filed for a person. You "just" have to - Re: I-140 & DS-156
It's one of the many things which will be considered when deciding
whether or not to admit you. In the past you've explicitly declared a
wish to reside in the USA, so that increases the risk that you'll stay
illegally if they let you in. As long as your travel patterns to the USA
are reasonable and you've never overstayed an admission, it's unlikely - Re: I-140 & DS-156
