A: You have to last for 8 more months or so. Fortunately for you, statute of limitations on debt in New York State is 6 years for all contract types - Oral, Written, Promissory Note and Open Account. New York does have 10 year

A: You are in luck, as long as your paycheck comes from Texas, and not from an out-of-state location. There is no wage garnishment in Texas, as state constitution makes current wages exempt property. The only garnishable exceptions are child support, student loans, bank accounts, rents and royalties - to the best of my knowledge. Tell the creditor that the threats are very likely in violation of the Federal Debt Collection Act, as it has no legal authority for garnishment.
